This website is operated by Walk By Faith Fitness, LLC (WBFF). Throughout the “Site” “site”, the terms “we”, “us” and “our” refer to WBFF and/or its associates. By visiting this website and/or purchasing any item, reading or taking in any posted materials from us, you willingly participating and engaging in our “community” “service” and 2“services,” and agree to be bound by the following Policies, Terms, and Conditions (“Terms of Service”, “Terms” “Policy” “Policies” “Terms and Policies” “Policies and Terms” “Beliefs” “Morals” “standards” “statement”), included, and by any policies referenced herein and/or available by hyperlink. Our Terms and Policies apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of its content.

If you DO NOT agree to ALL the terms and conditions of this agreement, then you may not access the website or use any of our Services. If these Terms are considered an offer, acceptance is expressly limited to these Terms of Service.

SECTION 1: RETURN-REFUNDS AND/OR RETURN-EXCHANGES:-

If you desire to return a product you have purchased from WBFF online, you understand and agree to the following:

(1a) You must return the item within 14 calendar days from the date you received it.

(1b) Only items that have been purchased directly from WBFF online can be returned to WBFF for a return or exchange. Any WBFF product purchased through other retailers is currently prohibited and anyone involved is subject to prosecution.

(1c) If returning and/or exchanging, it is your responsibility to ensure that the item is repackaged with all attached tags, strings, accessories, stickers, coupons, and any other perk that was included with that item when the purchase was shipped to you. The package also needs to be returned as one whole unit (the same way it was shipped to you) within the 14 calendar days.

(1d) The item you are returning and/or exchanging must not be damaged by you, or cannot have been worn by you either.

(1e) Only outerwear (non-intimate apparel/items can be returned for exchanges such as: shirts, pants, jackets, etc. (no sports bras, jock straps, etc),

(1f) Some items purchased through special promotions may be final sale, and are not eligible for exchanges or returns (please refer to Section 14 for the terms of each offer).

(1g) WBFF reserves the right to make any final decision regarding a refund or exchange.

SECTION 2: RETURN-REFUNDS AND/OR RETURN-EXCHANGES: CONSUMER EXPERIENCES MADE EASY -

WBFF strives to provide an amazing shopping experience and superior customer service.

(1a) We encourage customers to carefully take measurements and know your sizes before any purchase.

(1b) You also have the option to consult with one of our Customer Service Representatives, if you have questions prior to purchasing or you can visit our FAQ page for information as well.

(1c) Unused items with original packaging as described in SECTION 1 are welcomed as needed. Exchanges are currently not available outside of the US, and orders can only be returned.

(1d) Some items purchased through special promotions may be final sale, and are not eligible for exchanges or returns (please refer to promotion disclaimers for the terms of each offer).

(1e)You will be assigned a unique code for any return-refund and/or return-exchange, to expedite the process and to create a smooth process for your experience.

(1f) A Customer Service Representative will be connected to your unique code to see your process through from beginning to end, and can help you return or exchange your item(s) and find the perfect replacement.

(1g) If you haven’t received your refund after 10 business days from the time your return was received at our warehouse, please let us know so we can further investigate the situation. Australia: Exchanges are not available in Australia, and orders can only be returned. Some items purchased through special promotions may be final sale, and therefore not eligible for exchanges or returns (please refer to Section 14 for the terms of each offer).

(1h) Please note, return-refunds are limited to three per customer per year.

SECTION 3: BILLING, ACCOUNT AND INVOICE INFORMATION -

WBFF reserves the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You understand that your content (not including credit card information), may be transferred unencrypted and involve:

(3a) transmissions over various networks; and

(3b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is encrypted during transfer over networks.

(3c) WBFF does not issue hidden fees, we itemize invoices and do our best to make sure fees are easy to read and understand

(3d) Some items purchased through special promotions may be final sale, and are not eligible for exchanges or returns (please refer to Section 14 for the terms of each offer).

SECTION 4: ORDERING, SHIPPING & HANDLING -

WBFF offers FREE US Shipping for orders over $200. When you make a purchase of an item from us, you will be assigned a unique order number and a package tracking code, which will be emailed to you so you are able to track your order until it arrives at the address you provide to us when making your purchase. WBFF uses the most cost effective shipping methods/rates possible. You agree to provide current, complete and accurate purchase and account information for all purchases made on our site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. We do our best to use the most efficient, cost-effective delivery methods/carriers. WBFF cannot guarantee third-party services; however, we will always investigate, correct, and address situations beyond our control as it relates to any shipping and handling issue. We typically process orders within 1-5 business days. Please allow additional time during sales and holidays. Shipping times will vary depending on where you live. We do not ship on Sundays or holidays. If your order requires that you pay for shipping, we are not able to refund or issue store credit for those shipping charges.

You represent that you are at least the age of majority in your state or province of residence, or that you have been given legal consent or allowed your minor dependents to use this site.

Our products are limited quantities and are subject to returns and/or exchanges only according to our return-refunds and return-exchanges Policies.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of any product, service, or information.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors will be corrected.

A breach or violation of any of the Terms or Policies will result in an immediate termination of your purchase or our services provided to you and may result in an interception of delivery of any item to be returned to us, as determined by us.

SECTION 10: DISPUTE RESOLUTION -

Our customers’ satisfaction is of the utmost importance to us. We value every experience of every person, and/or purchase, no matter the case. Therefore, we will do all that is within our resource powers to make any situation satisfactory for each consumer or visitor of our site. In the event that a matter cannot first be resolved between WBFF and a consumer or visitor of our site, under the management of our customer services standards, and our Terms and Conditions; any and all disputes, issues and controversies, or matters arising herefrom, related hereto, or otherwise arising from or related to this site, these matters shall be governed by or construed exclusively in accordance with the laws and decisions of the State of Colorado without giving effect to its choice of law or conflict of law provisions. You agree that you are willingly engaging in the WBFF community or consuming any of our products from a Colorado based company, the State and federal courts sitting in Colorado overrule all other courts in other states and countries. Furthermore, by utilizing this site and as a consumer, you hereby consent to the jurisdiction of all applicable Colorado state and federal courts powers and authorities. And finally, as a consumer of this site you agree that you have read and understand all terms and conditions, and by continuing the use of this site and its products are making a sound a decision to not sue, hold liable, or bring forth any lawsuit against WBFF, its owners, board members, partners, consultants, employees, volunteers, or any of its associates. Therefore, you are agreeing to the Terms and Conditions and use, operations, and resolving any conflicts. If you should seek counsel and decide to move forward with any litigation actions, you agree to be liable for all WBFF’s legal fees as well. (10e) YOU MUST FILE ANY CLAIM WITHIN ONE (1) YEAR AFTER SUCH CLAIM AROSE OR IT IS FOREVER BARRED.

If you need to cancel or revise an order, please contact our customer service department via the customer service email provided on the “contact us” page right away. We will do our best to accommodate your request, but we cannot guarantee revisions or cancellation after an order has been placed. WBFF orders cannot be cancelled or altered once submitted to our fulfillment team for processing. If an order needs to be cancelled on our behalf for any reason, we will contact you with the most recent email we have on file for you, as soon as possible. Unless the cancellation reason is associated with your actions as mentioned in Sections 8, and/or Section 9 of these Terms and Conditions. Should this be the case, WBFF would investigate and assess the matter, and follow its Policies as stated in Sections 7, Section 10, or elsewhere applied in these Terms.
